The Fourth Amendment to the U.S. Constitution protects people and their property against arbitrary search and seizures. 


Regardless of your citizenship or immigration status, you have the right to remain silent. You do not have to answer questions about your immigration status. You may tell the officer that you will only answer question in the presence of an attorney. 

    

An officer needs a reasonable suspicion in order detain you. Meaning that an officer will need specific facts about you being in violation of a law in order to detain you.

    

An officer cannot search you or your property unless the officer has probable cause or you give the officer consent to search you or your property. You have the right to say no.

    

An officer cannot arrest you without probable cause of you violating any law.

   

Neither your silence, race, or ethnicity alone will satisfy the reasonable suspicion or probable cause requirement.
